<strong>District Court of Appeal Finds in Favor of Disabled Retired Firefighter</strong>  <span id="more-1862"></span></p>

<p>Firm Partner Jim Daniel recently obtained a favorable ruling from the First District Court of Appeal (DCA) on behalf of retired Jacksonville firefighter Graymond “Rusty” Butler. He was awarded permanent total disability benefits previously denied him by his former employer, the City of Jacksonville.   “After faithfully serving the citizens of Jacksonville and putting his life in danger for over three decades, Rusty will now finally get the compensation he deserves,” comments Jim.</p>
<p>Rusty first brought his case to Jake Schickel, who is board certified in Workers’ Compensation and Civil Trial Law. Health issues had forced Rusty into early retirement. Like so many of his fellow firefighters and police officers, Rusty was diagnosed with hypertension with resulting peripheral vascular disease. “It’s the stress of the job that causes it,” explains Rusty. “I know a lot of people I served with are having trouble getting their benefits.” </p>
<p>This is exactly what brought the former firefighter to Jake Schickel. Jake’s investigation revealed that while his medical expenses had been paid, Rusty had not received all the benefits owed him, despite meeting the guidelines for total disability. Jake was certain that his client’s case was fully supported by the Florida Statute known as the “Heart Lung Bill” and began a long fight to obtain rightful compensation. This law stipulates that firefighters and police officers are entitled to a presumption that hypertension or heart disease, and any complications resulting from these conditions, are causally related to their employment. </p>
<p>Despite this statute and without presenting any evidence disproving this causal relationship, the city vigorously contested Rusty’s claim, even sending him to an Orlando doctor who testified against him. After Judge William Dane ruled in favor of the city and denied benefits, Jim Daniel, a board-certified specialist in Appellate Law, filed the appeal that reversed that decision. </p>

<p>A Clay County jury recently found for Jacksonville resident Walter Pace in his suit against a motorist who had fallen asleep at the wheel and crashed into the back of his vehicle.  The verdict was 21 times greater than the final offer made by the State Farm adjuster, who insured the driver at fault.<br />
State Farm staked out its position on the case during Mr. Pace’s first conversation with this adjuster, who took a hostile, “take it or leave it” stance. He told Walter that he did not believe he was injured in the accident and that he would make sure there was no settlement offered in the case.  “He told me that he was going to make an example of me by forcing me to go to trial — which he was sure I would lose,” said Walter Pace.<br />
It all began in July of 2002 in Green Cove Springs, Florida as Walter and his family were traveling on US 17 on their way to teach vacation bible school in nearby Switzerland.  Walter Pace was sitting in the back seat while his wife drove, allowing one of his children to ride “shotgun.” John Moore, a construction worker, was traveling behind the Pace vehicle.  Moore had gotten up before dawn to work at his job site and then he went surfing.  When he reached Green Cove Springs, he fell asleep at the wheel, accelerated, and crashed into the back of the Pace vehicle.<br />
Our investigation revealed that Walter had a previous neck condition that was in no way bothersome prior to the accident, but had now become significantly worse.   After the accident, Mr. Pace had to struggle to approach his old level of physical activity.  A sole proprietor and master artisan in a business engaged in handcrafting control panels for sewage and wastewater management systems, Walter found it increasingly difficult after the accident to do the work that had previously been his source of income. He had lost his biggest client and seen his earnings decrease dramatically each year. By 2005, Walter’s income was less than half of what it had been in the years preceding the accident.<br />
Convinced that State Farm’s position was grossly unfair to Mr. Pace, our firm took the case to trial.  They believed Walter Pace and they believed in his case.  The jury saw their passion and, in the end, they too believed Walter Pace.  “This case illustrates the type of treatment by insurance companies we see all too frequently,” said Attorney Rick Alexander.  “It also shows how the jury system can work to vindicate a real victim, even though he is denied by an insurance company.”<br />

<p>In January of 2006 Angie Vazquez and her then-fiancé, Chuck Kees, were excited about the opening of the film “King Kong.” The couple visited Jacksonville’s Regal Beach Theater to view the remake of the famous 1933 classic. They were unaware that the evening would cost them significantly more than the price of tickets and popcorn.<br />
During the three-hour movie, Angie started down the stairs to use the restroom. Her vision and depth perception were impaired by extreme low light and uneven stadium-style steps. She tripped and fell, breaking both bones in her left wrist. This serious injury forced her to undergo surgery and wear a cumbersome external fixator for several months, including during her own wedding. A professional with a career that requires a certain amount of strength and dexterity, Angie found that she had lost some of her previous functionality. She comments: “I can’t physically do everything I used to – I have to ask my colleagues for help.”<br />
The theater where Angie was injured is part of Regal Cinemas, Inc. &#8212; the largest chain of movie houses in the country.  After she found the corporation non-responsive to the issues and expenses related to her accident, Angie brought her case to our firm. Partners Charles Sorenson and Howard Coker, working with firm Investigator Walt Brozowski and Paralegal Leigh Phillips, launched an investigation into the hazardous conditions at that cinema, as well as the safety codes that govern theater operations. It became clear that the cinema’s inadequate, out-of-code aisle illumination was a breach of its duty to maintain safe premises for patrons. In short, leaving one’s seat during a movie was risky business! In August, a jury agreed with our firm’s findings, awarding Angie Vazquez $233,000.<br />

<p>Siegel v. Wheeltronic</p>
<p>Jefforey Siegel loved his work and his company, Big Chief Tire.  A veteran mechanic, he had worked hard to be promoted to supervisor.  On August 15, 2006 his situation changed in an instant when he was working under a Ford F-250 and the hydraulic lift holding the 9000 lb. truck failed.  Jefforey was pinned to the wall of the garage, fracturing bones, dislocating his shoulder and tearing muscle.  At that time he weighed in at about 300 and was able to use his body mass and strength to push the truck off himself.  “It was in the blink of an eye.  I feel really lucky – if it has been someone else in the shop smaller than me they would have been dead,” Jefforey comments .<br />
Luck in one sense is certainly correct, however Jefforey was seriously injured by a scissor lift that  failed suddenly and at a crucial moment.  It turned out that a specific weld on the lift was in the wrong place and, with continual use, it gave out, endangering any mechanic counting on it to keep a bone-crushing vehicle from crashing down on them as they worked.  The product was manufactured by Wheeltronic, a Canadian company and distributed by Snap-On.<br />
Jefforey required three surgeries and he will never be able to work as a mechanic again.  This is something he deeply regrets.  During our investigation into the case, our firm learned that the lift was not adequately tested for safety and that welds were in locations where solid pieces of steel should have been used. “The welds that were present on the lift were too weak to support the loads properly placing on it and it had an inadequate safety system because users of the lift would not be able to see fatigued welds prior to failure,” explains Partner Matthew Posgay, who represented Jefforey Siegel in this case.<br />

<p>Charles Sorenson and Aaron Sprague recently negotiated a $2.2 million settlement for their client, Eric Geidel, and his wife, Patricia. Permanently disabled due to the negligence of a commercial trucking company, Eric’s case exemplifies the frequency and severity of trucking accidents on our roadways today.</p>
<p>On June 18, 2004, Eric was stopped at a red light when a commercial truck traveling at 55 mph crashed into the back of his vehicle. The truck driver had lost control of his vehicle while in the throes of an epileptic seizure. Upon impact, Eric’s vehicle was fast-forwarded into a car in front of him. The dual collisions resulted in serious shoulder and knee injuries that required extensive treatment.   </p>
<p>An 18-year U.S. Postal Service veteran, Eric&#8217;s impairments and surgical requirements forced him to leave his employment. Within months after the accident, a dramatic change began to occur in Eric&#8217;s condition.  He experienced a significant loss of balance, together with severe memory loss and headaches. He was then diagnosed with hydrocephalus &#8211; a condition where the spinal fluid production is thrown out of balance, creating a pressure that causes permanent brain damage.<br />
 “My husband has been completely changed. He has lost his memory, his ability to do the simplest things, to work and experience life &#8211; all because his brain no longer functions normally or as it once did.  This has hurt our quality of life in every way imaginable,” said Patricia Geidel.</p>
<p>When Eric’s brain damage became apparent, we responded to that in our pursuit of the case. Attorney Charles Sorenson explains: &#8220;In working closely with our client, we observed the change in his condition. At the point that his irreversible brain damage was diagnosed by doctors, we knew the case had become more complex, with damages much greater than had first been evident.  We then adjusted our approach to ensure that his compensation was commensurate with the catastrophic nature of his injury.&#8221;<br />

<p>A recent eve-of-trial $650,000 settlement concluded a trucking accident case that forever changed the life of a Starke, Florida, construction superintendent. Our client, plaintiff Mark Garrison, was anxious to avoid the trial process and end his two-year battle with the defendants.  “I wanted to get it settled; I am still in a lot of pain and really was not up to the trial,” he said.</p>
<p>The case was brought by Partners Charles Sorenson and Howard Coker against the trucking company and their driver.  In January of 2005, Mr. Garrison was on his way to work at a construction site in his Ford F-150 pick-up. It was a still-dark and foggy 5:30 am when he unexpectedly came upon an 18-wheeler blocking all lanes of traffic.</p>
<p>With no running lights on the side, the truck was made invisible by the fog.  Our client did not see it until the last moment and had no opportunity to take evasive action.  He braked, but could not stop in time to avoid crashing into the rear wheel of the trailer.  His rate of speed on impact was determined to have been between 45-50 mph, which, although within the posted limit, resulted in a fairly high-velocity crash.</p>
<p>Mark Garrison was fortunate to be in a sturdy vehicle, to be wearing his seatbelt and to have an airbag that deployed.  “I don’t want to think about what would have happened to me if I had been in a small car when I hit that truck at that speed,” he said. Even with these advantages, the accident caused him serious injuries. A crushed heel bone, along with nose, back, and rib damages forced him to resign his employment and take permanent disability.  The financial and quality-of-life impacts on the Garrison family were tremendous. </p>
<p>The trucking company, however, did not want to accept responsibility for the accident. Charles Sorenson explains: “It was a heavily contested case &#8211; the defendant insisted that their vehicle was clearly visible and pointed out that another vehicle in the same path was able to stop and avoid collision.  We were convinced of the negligence of the truck driver and excited about the prospects of trial.  However, we respected our client’s wishes to accept a settlement that met his and his family’s financial needs.”<br />

<strong>Man Suffers Serious Injury When His Vehicle is Crushed Between Semi Trucks</strong>  <span id="more-1849"></span></p>
<p>STEVENS v. CCC &#038; PRITCHETT TRUCKING</p>
<p>By all accounts, the weather in the early morning hours of December 3, 2002 was some of the worst Putnam County has ever seen.  There was a “pea soup” fog and visibility was further obscured by the presence of thick smoke from a nearby swamp fire burning underground. </p>
<p>In response to these dangerous conditions, Kenneth and Cloeva Stevens were moving cautiously at a slow speed on State Road 100 when they suddenly came upon a “semi” stopped in the road ahead. Mr. Stevens managed to stop his Ford 150 pickup in time to avoid a collision. Impeded by the guardrail next to him, he pulled as far off the highway as possible. He then realized that the Pritchett trucker in front of him was cab-to-cab in conversation with another trucker. Between the trucks blocking both lanes and the guardrail, the Stevens had no choice but to sit and wait in their vehicle.<br />
The Stevens did not see the “big rig” barreling down on them from behind and had no time or opportunity to take any evasive action. Operated by Commercial Carrier Corporation, the “semi”  slammed into the couple’s vehicle, instantly crushing the truck bed, tearing into the cab on the driver’s side and pushing the Ford into the back of the Pritchett “semi” still stopped ahead of them. The “big rig” driver was traveling at a high rate of speed for the hazardous road conditions &#8211; he had just passed another car illegally across a double yellow line and was just beginning to decelerate. He was not able to stop in time to avoid the sound-shattering collision with the Stevens.</p>
<p>With no real understanding of what had just happened, and in shock, Cloeva could see that her husband had sustained some type of head injury. She managed to pull him out of the badly damaged cab and over the guardrail to the ground below. Both Mr. and Mrs. Stevens sustained serious and permanent injuries.  </p>
<p>Representing the Stevens, Howard Coker and Charles Sorenson, in Co-Counsel with attorney Don Lester, recently brought the liability portion of the case to trial in front of a Putnam County jury who found the two trucking companies 90% responsible for this horrific highway accident.  Charles Sorenson commented, “During trial we learned that the Commercial Carrier truck was equipped with a proximity alert system that sets off an alarm if there are objects up to 300 feet in the front or the side of the truck’s path. Manufactured by Eaton-Vorad, this new technology is a radar system, much like that used in boats and is designed to work in any type of weather or road condition. What amazes us is that that sophisticated system still did not prevent CCC’s semi from slamming into our client’s vehicle.”<br />

<p>As she caught her breath, a dazed Yvette White watched her air bag deflate and stared at the trunk of the big palm tree &#8211; a tree that was now sitting where the grill of her car used to be.  She realized that she had been hit by another driver; what she did not realize was that this day marked the end of her career as a Greyhound Bus Driver.  </p>
<p>It was Saturday, October 20, 2001, and Yvette was heading to work at the Jacksonville Greyhound Terminal when a car blew through a stop sign and struck Yvette’s vehicle, breaking her axle and forcing her car to careen over the curb and smash head-on into the large palm tree. At this point her windshield shattered and glass flew throughout her car’s interior. </p>
<p>In addition to abrasions and contusions, Yvette White suffered painful internal neck and back injuries; she began a cycle of therapy that has lasted to this day.   Ultimately, her doctor placed work restrictions on her that were definitely at odds with her job requirements. In December of 2004, Greyhound put her on long-term disability, a status that provides no salary and no benefits. </p>
<p>This was a blow to Yvette; driving for Greyhound was a job that the 33 year old really enjoyed.   Moreover, apparently she was good at it; Yvette had been named “Top Dog” in a national company newsletter.  Fortunately, on June 30, 2005, her attorneys Rick Alexander and Aaron Sprague persuaded a jury to find in her favor, awarding her an amount that exceeded the defendant’s insurance policy.<br />
